Terms of Service

These terms form an agreement between you and Filmotion, registered at Schansweg 9, 1791LK Den Burg, the Netherlands, company number 88008541 ("Filmotion", "we", "us"). By creating an account or using the service you accept these terms.
1. Your account
You need an account to use Filmotion. You must be at least 18 years old, or the age of digital majority in your country, and provide accurate information. You are responsible for keeping your login credentials secure and for everything that happens under your account.
One person or organisation per account. You may not share, sell or transfer your account. We may suspend or close an account that breaches these terms, is used fraudulently, or creates risk for us or other users. You can close your account at any time from your account page.
2. Credits and what they cover
Filmotion is metered in credits. A credit is an internal unit of account that entitles you to a defined amount of generation work — for example rendering a video, analysing an uploaded episode, or generating a clip. The credit cost of each action is shown in the app before you confirm it and may change as our underlying costs change.
Credits are a prepaid entitlement to use the service. They are not money, not a stored value instrument, and carry no cash value. They cannot be exchanged for cash, transferred between accounts, or refunded once used.
Credits expire. Credits included with a paid subscription expire at the end of the billing period in which they were granted and do not roll over. Credits bought as a one-off pack expire 30 days after purchase. Free credits expire as stated in the app when they are granted. Credits are always consumed oldest-first. Expired credits are lost and are not refundable or restorable.
3. Acceptable use
You agree not to use Filmotion to create, upload or publish content that:
- infringes anyone's copyright, trademark, privacy or other rights;
- is unlawful, defamatory, hateful, harassing, or incites violence;
- is sexual content involving minors, or non-consensual sexual content;
- impersonates a real person, or uses someone's face, voice or likeness without their permission;
- constitutes regulated advice — including financial, investment, legal, medical or tax advice — presented as coming from us;
- is deceptive, spam, or designed to manipulate a platform's distribution systems.
You also agree not to reverse engineer the service, scrape it, resell access, circumvent credit metering or rate limits, or use it to build a competing model or product. You must have the rights to every file you upload, including audio, video, images and any voice or likeness in them.
You are responsible for complying with the terms of any third-party platform you publish to (for example YouTube, TikTok, Instagram, Facebook or X), including their disclosure rules for AI-generated content.
4. Ownership of generated videos
You own your inputs. You keep all rights in the prompts, scripts, images, audio and video you upload. You grant us a limited licence to host, process and transmit them for the sole purpose of operating the service for you — including sending them to the processors listed in our Privacy Policy.
You own your outputs. As between you and us, you own the videos, clips, captions and voiceovers generated for you, and you may use them commercially. Our rights in the platform itself — software, models, templates, engines, music library metadata and branding — remain ours.
AI output is not unique. Similar prompts may produce similar results for other users, and we cannot guarantee that any output is original, copyrightable, or free of third-party rights in your jurisdiction. Licensed music and stock elements remain subject to their own licences.
You are responsible for what you publish. Reviewing a generated video for accuracy, legality and platform compliance before publishing it is your responsibility, not ours.
5. No guarantee of performance
The service is provided "as is" and "as available". We do not promise a specific uptime, render speed, queue position, output quality, or that the service will be uninterrupted or error-free. Generation depends on third-party AI providers whose availability, models and behaviour can change or be withdrawn without notice, and we may change or replace models and features at any time.
We make no promise about results you achieve with the videos — views, followers, engagement, revenue, reach, or acceptance by any platform. Nothing generated by Filmotion is financial, investment, legal or professional advice.
Automated posting depends on third-party platform APIs and their review processes. Where a platform rejects, delays or removes a post, that is outside our control.
6. Subscriptions, renewal and cancellation
Paid plans are sold as a monthly subscription at the price shown at checkout, inclusive of applicable VAT. The subscription renews automatically each month on the same date, and we charge your saved payment method until you cancel.
You can cancel at any time from your account page. Cancellation takes effect at the end of the current billing period: you keep access until then, and no further payments are taken. We do not pro-rate unused parts of a period unless the law requires it. Any subscription credits remaining at the end of that period expire as described in section 2.
One-off credit packs are separate purchases and are not a subscription. If you have enabled automatic top-ups, we buy a pack on your behalf when your balance falls below the threshold you set; you can switch this off at any time.
We may change prices or plan contents with at least 30 days' notice by email. If you do not accept a change, you may cancel before it takes effect. Failed payments may result in suspension of paid features until payment succeeds. Refunds and the statutory right of withdrawal are covered in our Refund Policy.
7. Limitation of liability
Nothing in these terms limits liability that cannot be limited by law — including for death or personal injury caused by negligence, fraud, or your non-waivable statutory rights as a consumer.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, revenue, goodwill, audience, data or content, business interruption, or losses caused by third-party AI providers or publishing platforms. Our total liability for all claims arising in any 12-month period is limited to the greater of the amount you paid us in the 12 months before the claim, or EUR 100.
You agree to indemnify us against claims arising from content you upload or publish, or from your breach of these terms.
8. Affiliate programme
Any account holder may take part in our affiliate programme — no approval is needed. If you share a referral link or earn a commission, our Affiliate Programme Terms apply in full.
Commissions are earned only when a person you referred actually pays for a subscription or credits — never for recruiting other affiliates. Earnings figures shown on profiles and the leaderboard are real figures from those accounts, but they are not typical results and not a promise of what you will earn.
You are responsible for tax on your commissions. As an EU platform we may collect your details and report affiliate earnings to the tax authority under EU DAC7 rules.
9. Changes, law and contact
We may update these terms; material changes will be announced by email or in the app before they take effect. These terms are governed by the laws of the Netherlands, without prejudice to the mandatory consumer protections of your country of residence in the EU. Disputes go to the competent courts of that country.
